Appellate Court Rules in Favor of DraftKings, FanDuel

Appellate Court Rules in Favor of DraftKings, FanDuel in New York - An appellate panel has ruled in favor of daily fantasy sports sites DraftKings and FanDuel, allowing both to continue operating in the state of New York while their appeal is being heard, according to Darren Rovell of ESPN. The sites are currently appealing a ruling by the New York Attorney General Eric Schneiderman who said daily fantasy sports is a form of gambling.

Rovell tweeted shortly after 1 pm EST Monday:

Breaking: FanDuel & DraftKings granted permanent stay by appellate panel in NY.  Can take biz from New Yorkers throughout the appeal.

That appeal is expected to last into the summer with a series of filing deadlines spread across the next six months.

A judge had previously ruled that DraftKings and FanDuel were not permitted to operate in the Empire State, however, that decision was quickly overruled when a judge granted both Daily Fantasy Sports firms an emergency stay that was set to expire this month.
