DraftKings and FanDuel have successfully obtained an injunctive relief through an emergency order which will allows both daily fantasy companies to continue to operate in the state of New York.
FanDuel had already ceased operations in NY, while DraftKings remained in business. The emergency order filed by the powerhouse NY law firm of Debevoise & Plimpton and Gibson Dunn & Crutcher was signed this last this afternoon by the Appellate Division of the Supreme Court of the State of NY.
Early today the Honorable Manuel Mendez issued an earth-shattering decision to grant the motion of the NYS Attorney General to suspend the authority of the both companies to do business in the state. By winning an appeal of today’s decision – via this preliminary injunction and TRO – each company will be allowed to continue to operate in New York State thru January 4th.
By that date all parties will have to had completed their submissions to the Appellate Division. The entire appeal process will be subject to review by a panel of four or five justices, and the appeal will probably play-out for several months.
